Deloitte Risk & Financial Advisory ("Advisory")'s Contract Obligation Tracking (COT) program is a control-based program that helps engagement teams in understanding key contractual obligations, designing risk mitigation strategies and monitoring contractual risks on a periodic basis. The Operate portfolio of accounts continues to grow and requires a specialized team within the Quality & Risk Management ("QRM") team to focus on post-signature contract compliance risks. This role will be part of the QRM team within the Operate Portfolio. The person in this role will lead implementation and institutionalization of this new program focusing on Advisory's most complex contracts for Operate services. The primary focus will be on the post-signature aspects of contract management including Advisory's compliance with contractual obligations, supporting ongoing contractual obligation monitoring, and facilitating the business teams in implementing appropriate risk mitigation strategies. The role includes both a leadership dimension and an individual contributor dimension.
Work you'll do
Manage and institutionalize the COT program that will address Deloitte Advisory's post-signature compliance with Operate contractual obligations and provide support for ongoing contractual risk mitigation strategies and issue resolution;
Develop approaches, methods, templates, and tools for execution of post-signature contract compliance program in collaboration with the Operate QRM leadership, engagement leaders, other groups within QRM and Office of General Counsel (legal team)
Improve approaches, methods, template, and tools on an ongoing based on results and feedback
Recommend, support, and socialize for adoption, an execution model for post-signature operations risk activities that distributes duties among various stakeholder groups including engagement leaders, engagement PMO teams and other teams outside Operate QRM team
Liaise and lead meetings with the business leadership team and market offering QRM's to review and baseline contractual obligation for ongoing tracking and provide guidance to the business leadership team on potential risk mitigation strategies for complying specific contractual requirements
Provide support and guidance for the resolution of contractual matters by performing thorough research of tiered contracts, preparing analysis of potential options for resolution/response, and preparing draft communications to support Deloitte Advisory's positions
Generate periodic reports, trends, and analytics to monitor program performance and report them to the Operate QRM and business leadership teams
Continuously improve the post-signature operations risk support model, approach, tools, templates, and artifacts to optimize Deloitte Advisory's ability to comply with the contractual restrictions, obligations and notice requirements
Lead the offshore Operate COT program team; as the leader of the COT program team, this person will Liaise with offshore team to coach, mentor, and train them on the contract obligation tracking approaches, methods, templates, and tools
Conduct contract review/retrospective/lessons-learned; promote information-sharing to improve future contract negotiations and contractual outcomes for future engagements
Using established method, templates, and tools, develop and implement account-specific contract management tools including annotated templates, obligations trackers, contracting guidebooks, and methods and processes essential for successful contract compliance during delivery of engagements
Manage technology platform (ServiceNow GRC); liaise with the platform technology teams to define, implement, and deploy technology roadmap for the Advisory Operate COT program
Qualifications
Required
5+ years of direct contract management/strategy, negotiation and/or risk management experience including strong contractual fluency, complex, IT SOW negotiations, dispute resolution, global contracting and subcontracting
3+ years working with licensed technologies (e.g., specialized software, cloud capacity/platforms)
3+ years working directly with senior level executives
3+ years consulting experience focused on complex, IT services contracting
Strong oral and written communication skills and the ability to construct and negotiate sufficient contractual provisions addressing business issues
Education: Bachelor's Degree
Must be legally authorized to work in the United States without the need for employer sponsorship, now or at any time in the future
Ability to travel up to 10% (While up to 10% travel is a requirement of the role, due to COVID-19, non-essential travel has been deferred until further notice)
Preferred:
Experience with technology platform(s) such ServiceNow GRC for managing contract obligation tracking process
Experience evaluating and addressing contractual risk related to IT and asset-based (hybrid) professional services or familiarity with operate specific contract terms
Direct client-facing experience related to commercial contracting in multiple industries
Experience optimizing off-shore teams for support, including training and mentoring
Results-orientation and ability to flex based on urgency
Negotiation skills that can be applied both internally and externally
Strong track record of success in the Risk and Contract Management domain and/or in client service delivery specific to complex IT services
Strong track record of understanding and navigating creative deal structures
Ability to understand the Firm's complexity and how to navigate successfully
Ability to work autonomously in a matrixed, fast-paced, multi-task environment
Law degree or MBA
